Terms of service

1. About us

1.1. The website www.meusperfumery.com (the "Website") is operated by NICHESCENT S.R.L., with its registered office at Str. Tiberiu Brediceanu nr. 7B, Arad, Romania, registered with the Romanian Trade Register under no. J2017002031022, VAT number RO38530802 ("we", "us" or the "Seller"). The Website and our stores operate under the Meus Art Perfumery brand.

2. Definitions

2.1. Customer: any natural or legal person who places an Order on the Website. A Customer who is a natural person acting for purposes outside their trade, business or profession is a Consumer and benefits from the rights granted by consumer protection law.

2.2. Products: the goods offered for sale on the Website.

2.3. Order: a request submitted by the Customer through the Website to purchase one or more Products.

2.4. Contract: the distance sales contract concluded between the Seller and the Customer through the Website, under these Terms of Service.

2.5. Account: the area of the Website, accessed with the Customer's email address, where the Customer can view their details and order history.

3. Acceptance of these Terms

3.1. By placing an Order, the Customer confirms that they have read and accept these Terms of Service, in the version published on the Website at the time the Order is placed.

3.2. We may update these Terms of Service from time to time. A new version applies only to Orders placed after its publication on the Website. Orders already placed remain subject to the version in force when they were placed.

4. Customer account

4.1. Creating an Account is not required to place an Order. Customers who create an Account are responsible for keeping their login details confidential and for keeping their Account information up to date.

4.2. Creating an Account does not mean consenting to marketing communications. These are sent only to Customers who have separately and expressly subscribed, as described in Section 13.

5. Products and prices

5.1. All Products sold on the Website are new, authentic and in the manufacturer's original packaging.

5.2. We make every effort to ensure that Product descriptions, fragrance notes and images are accurate. Colours in photographs may vary slightly depending on screen settings.

5.3. Prices are shown in Romanian lei (RON) and include VAT. For deliveries outside Romania, the Website may display prices converted into the local currency. The amount charged is the one shown at checkout. Your bank may apply its own currency conversion fees.

5.4. Delivery costs are not included in Product prices. They are shown before the Order is completed, as set out in Section 8.

5.5. If a Product is displayed at an obviously incorrect price, we will contact the Customer before shipping. The Customer may confirm the Order at the correct price or cancel it, in which case any amount paid is refunded in full within 14 days.

6. Orders and conclusion of the Contract

6.1. To place an Order, the Customer adds Products to the cart, enters the delivery and billing details, selects a payment method and confirms the Order.

6.2. After the Order is placed, the Customer receives an automatic email confirming that the Order has been received. This email does not represent acceptance of the Order.

6.3. The Contract is concluded when we confirm to the Customer, by email, that the Order has been accepted or shipped.

6.4. We may refuse or cancel an Order, informing the Customer, if the Product is no longer in stock, if the details provided are incomplete or incorrect and cannot be clarified, if payment has not been confirmed, or if there are reasonable indications of fraud. Any amount already paid for a cancelled Order is refunded in full within 14 days of cancellation, using the original payment method.

7. Payment and invoicing

7.1. Payments are made online by card, processed securely through Shopify Payments and NETOPIA Payments. The payment methods available for each Order are shown at checkout.

7.2. We do not store or have access to the Customer's full card details.

7.3. We issue an invoice based on the details provided by the Customer and send it electronically to the email address used for the Order and/or in paper form together with the Products.

8. Delivery

8.1. Romania. Orders delivered in Romania are shipped by FanCourier and usually arrive within 1 to 3 business days from the confirmation of the Order. Delivery costs 25 lei for Orders under 1,000 lei and is free for Orders of 1,000 lei or more.

8.2. International. Orders delivered outside Romania are shipped by DPD International to the countries available at checkout and usually arrive within 3 to 10 business days, depending on the destination. Delivery costs 125 lei per Order, displayed at checkout in the local currency where applicable. Free delivery applies only to Orders delivered in Romania.

8.3. For deliveries outside the European Union, the destination country may charge customs duties or import taxes. These are not included in the Product price or delivery cost and are paid by the Customer.

8.4. In all cases, Products are delivered within 30 days of the conclusion of the Contract. If we cannot deliver within this period, the Customer may cancel the Order and receive a full refund of all amounts paid within 14 days.

8.5. The risk of loss or damage to the Products passes to the Customer when the Customer, or a person designated by them other than the carrier, takes physical possession of the Products.

8.6. We recommend checking the parcel on delivery. If the packaging is visibly damaged, the Customer may refuse the parcel or ask the courier to record the damage, and should inform us as soon as possible.

9. Right of withdrawal

9.1. Consumers have the right to withdraw from the Contract within 14 days without giving any reason, in accordance with Romanian Government Emergency Ordinance no. 34/2014, which implements Directive 2011/83/EU. The withdrawal period ends 14 days after the day on which the Consumer, or a person designated by them other than the carrier, takes physical possession of the Products. If an Order containing several Products is delivered separately, the period runs from receipt of the last Product.

9.2. To exercise the right of withdrawal, the Consumer must inform us before the withdrawal period expires, either through our online Withdrawal and Return Form, by logging in with their email address and selecting the Order and the Products to be returned, or by a clear statement sent to contact@meusartperfumery.com, stating the Order number and the Products being returned. The full return procedure is described in our Return and Refund Policy.

9.3. The Consumer must send the Products, without undue delay and no later than 14 days from the day they informed us of their decision, to: Meus Art Perfumery, Iulius Town, 1st floor, Piața Consiliul Europei nr. 2, 300627 Timișoara, Romania. The Consumer bears the direct cost of returning the Products.

9.4. We will refund all payments received, including the cost of standard delivery, without undue delay and no later than 14 days from the day we are informed of the decision to withdraw. The refund is made using the same payment method used for the Order, unless the Consumer has expressly agreed otherwise, and without any fees for the Consumer. If the Consumer chose a delivery option more expensive than our standard delivery, the difference is not refunded. We may withhold the refund until we have received the Products back or until the Consumer has supplied proof of having sent them, whichever is earlier.

9.5. The Consumer is liable only for any diminished value of the Products resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

9.6. Under Article 16 of Government Emergency Ordinance no. 34/2014, the right of withdrawal does not apply to sealed goods which are not suitable for return due to health protection or hygiene reasons and which have been unsealed after delivery. Perfumes delivered sealed (with protective film) can be returned only with the seal intact. The right of withdrawal also does not apply to Products personalised at the Customer's request.

10. Legal guarantee of conformity

10.1. We are liable for any lack of conformity of the Products which exists at the time of delivery and becomes apparent within 2 years of delivery, in accordance with Romanian Government Emergency Ordinance no. 140/2021, which implements Directive (EU) 2019/771. Products must match their description on the Website and have the qualities normally expected of goods of the same type.

10.2. In the event of a lack of conformity, the Consumer is entitled to have the Product brought into conformity by replacement, free of charge. If replacement is not possible or is not carried out within a reasonable time, the Consumer is entitled to a proportionate price reduction or to terminate the Contract and receive a refund.

10.3. The Consumer should inform us of the lack of conformity at contact@meusartperfumery.com, preferably within 2 months of discovering it, stating the Order number, a description of the issue and, where possible, photographs.

10.4. The legal guarantee of conformity applies regardless of any commercial guarantee offered by the manufacturer and cannot be limited by these Terms of Service.

11. Liability

11.1. We are liable for the performance of our obligations under the Contract, as provided by law. Nothing in these Terms of Service limits the rights Consumers have under consumer protection law.

11.2. We are not liable for the use of Products contrary to the manufacturer's instructions. Customers with known sensitivities to certain ingredients should check the ingredient list on the packaging before use.

12. Force majeure

12.1. Neither party is liable for failure to perform its obligations if the failure is caused by force majeure, meaning an external, unforeseeable, unavoidable event beyond the parties' control. The affected party will inform the other party as soon as possible.

12.2. If the force majeure event lasts more than 15 days, either party may terminate the Contract, and any amounts paid for Products not delivered will be refunded in full.

13. Personal data and marketing communications

13.1. We process Customers' personal data in accordance with Regulation (EU) 2016/679 (GDPR) and applicable Romanian law. Details about the data we process, the purposes, legal grounds, retention periods and Customers' rights are set out in our Privacy Policy.

13.2. Our newsletter and other marketing communications are sent only to people who have expressly subscribed. Subscription is free, and Customers can unsubscribe at any time using the link included in every message.

14. Intellectual property

14.1. The content of the Website, including texts, photographs, graphics, logos and design elements, belongs to the Seller or its partners and is protected by copyright and trademark law. The trademarks of perfume manufacturers belong to their respective owners.

14.2. Reproducing or using the content of the Website for commercial purposes without our prior written consent is prohibited.

15. Governing law and disputes

15.1. These Terms of Service and the Contract are governed by Romanian law. Consumers residing in another country also keep the protection of the mandatory consumer law provisions of their country of residence.

15.2. We encourage Customers to contact us first, using the details in Section 1.2, so that any complaint can be resolved amicably.

15.3. Consumers may contact the Romanian National Authority for Consumer Protection (anpc.ro) and may use alternative dispute resolution (ADR) through the entities provided for by Romanian Government Ordinance no. 38/2015.

15.4. Disputes that cannot be resolved amicably will be settled by the competent courts, determined according to the law. Consumers keep the right to bring proceedings before the courts of their place of residence.

16. Final provisions

16.1. If any provision of these Terms of Service is found to be invalid, the remaining provisions remain in full force.
